August 9, 2005 Regular Meeting

Theresa Town Board          Regular Meeting       August 9, 2005

The regular meeting of the Theresa Town Board was held on August 9,
2005 in the Theresa Town Hall.  The agenda for this meeting was posted
at the Town Hall Board, TSB Bank, and the Theresa Post Office.   

The meeting was called to order by Chairman Paul Christian at 7:30
p.m.  The Pledge of Allegiance was recited.  Motion by Supervisor
Brian Caspary, seconded by Supervisor Frank Kuczkowski to approve the
agenda.  Motion carried. (3 ayes)  The minutes of the July 5, 2005
meeting were read by the clerk. A motion was made by Supervisor
Kuczkowski, seconded by Supervisor Caspary to approve the minutes.
Motion carried.  (3 ayes)  

FINANCIAL
The financial report was given by the Treasurer.  A motion was made by
Supervisor Caspary, seconded by Supervisor Kuczkowski to approve the
financial report as given.  Motion carried.  (3 ayes)   Budget status
report was reviewed.  Motion by Supervisor Kuczkowski, seconded by
Supervisor Caspary to approve payment of the bills.  Motion carried.

PUBLIC FORUM
Jim and Donna Neitzel asked the Town Board what they had done about
their complaint of zoning board members contacting Board of Appeals
members the night of their appeals meeting.  Supervisors Caspary and
Kuczkowski had talked with the Wis. Towns Association.  They
recommended that the Town contact their attorney and set up a meeting
with the zoning board members.  Chairman Christian will contact the
attorney.

CORRESPONDENCE
Chairman Christian read a letter from the state concerning the new
Statewide Voter Registration System (SVRS).  He also talked about the
Humane Officer training being offered, if anyone was interested.   
 
OLD BUSINESS
- Update on Michel’s Conditional Use Permit:  A letter from Attorneys
Arenz, Molter, Macy, & Riffle was read by Chairman Christian.   The
motion to dismiss the case of Geiger vs. Town of Theresa Board of
Appeals was denied.   As a result, Attorney Riffle wants to schedule a
meeting in closed session with the Board of Appeals to prepare the
brief by the court’s deadline of October 14, 2005.
- Salt Shed/Garage Contract with State:  No new information.
- Resolution for Emergency Government:  A motion was made by
Supervisor Caspary to adopt the resolution with the changes noted
therein.  Motion was seconded by Supervisor Kuczkowski.  Motion
carried (3 ayes).   The Fire Department will make the necessary
changes.  Warren Stanke stated that the Town needs to pass a
resolution adopting the National Incident Management System (NIMS) as
the standard for incident management   This system would provide a
consistent nationwide approach for federal, state, and local
governments to work together to prevent, prepare for, respond to, and
recover from domestic incidents. This resolution will be put on the
agenda for next month.
-Removal of Attorneys Arenz, Molter, Macy, & Riffle:  The Town’s
present insurance company has denied paying our claims for legal fees,
as they see this as the same case brought before the court when we
were insured with a different company, and that claims should be
submitted to that company.  The clerk has submitted the claims to the
previous insurance company.  The Town is waiting to hear if they will
reimburse us.  Rex Vane stated that our present insurance company told
him that they would pay the claims, but there is nothing in writing.  
 


NEW BUSINESS
-  SVRS Memorandum of Understanding:  This memorandum is basically an
agreement with the county to work together with the Statewide Voter
Registration System.  Motion was made by Supervisor Kuczkowski, and
seconded by Supervisor Caspary to approve the Memorandum of
Understanding.  Motion carried (3 ayes). 
- Town Hall Land Rental:  A land owner adjacent to the town hall asked
to rent land from the town on the south side of the hall for their
horses to get through to their pasture.  It was decided not to rent
the land because of liability issues. 
- Fleisher Rezoning:  A motion was made by Supervisor Caspary and
seconded by Supervisor Kuczkowski to rezone nine acres or less of
Brocnathan and Aubrey Fleisher’s land from A-1 Agriculture to A-2
Agriculture in order to create a separate parcel for the home and farm
buildings.  Motion carried (3 ayes).
- Visual Aids:  Chairman Christian said that the Board would like to
have some kind of visual aids for the meetings, especially the
Planning and Zoning meetings, so that all the people could see the
maps, etc.   Melvin Unglaub brought a chalkboard and easel out from
the back room, which could be used.  
- Damian and Jeff Adams – wholesale license to buy and sell vehicles: 
Damian and Jeff Adams were present to explain that they wanted to buy
vehicles from the auto auctions, fix them up, and resell them at the
auto auctions.  They would only be able to do two vehicles at a time. 
They just needed the town’s permission to do this before the state
would issue them the wholesale license.  It was decided that they
would need a Conditional Use Permit.
- Chairman Christian reported that several road signs had been stolen
in the town.
- Chairman Christian also reported that he had received a complaint
against John Kasmiski concerning junked farm machinery on his
property.
- Chairman Christian stated that the blacktopping was completed under
budget, crackfilling was done and the sealcoating was almost finished.
 

The next monthly meeting will be held on Tuesday, September 6, 2005 at
7:30 pm.

ADJOURNMENT
Motion by Supervisor Caspary, seconded by Supervisor Kuczkowski to
adjourn the meeting.  Motion carried. (3 ayes)
The meeting was duly adjourned at 8:30 p.m.
