TOWN OF THERESA ZONING AND PLANNING COMMITTEE
June 29, 2006

The June 29, 2006 meeting of the Zoning and Planning Committee was
called to order by Zoning Chairman Harlan Binder at 8:05 p.m.   Board
members present were Harlan Binder, Todd Bodden, David Benter, Rick
Steger, Dan Schmidt, Loren Christian, and Jim Krieger.  The minutes
from the May 19, 2006 Zoning and Planning Committee meeting were read
by the clerk.  A motion was made by Dave Benter to accept the minutes
as presented; motion was seconded by Dan Schmidt.  Motion carried (7
ayes).  
Re-Zoning Request:  Owner and Petitioner:  God Green Acres, Ltd.,
Gordon Giese, Sec’y
Chairman Binder read the re-zoning request of God Green Acres, Ltd.  
Gordon Giese explained his request.  He stated that the land is not
being farmed due to the steep incline.  The ten points listed in
Section 10.6 of the Town of Theresa Zoning Ordinance were discussed. 

1.  There is no driveway at present.
2.  There is not an unreasonable burden to local governments
3.  Not sure if the land is suitable for development.
4.  Could have air/water pollution or soil erosion problems
5.  No conflict with remaining agriculture 
6.  No alternative locations
7.  Agricultural lands are not presently used for agriculture
8.  There is no agricultural land being converted to nonagricultural
use
9.  Rezoning is consistent with Comprehensive Plan
10.  Lot would be sold by owner.
Vote:  The Board voted to rezone seven acres from A-1 Prime
Agriculture to A-2 General Agriculture.  (7 Yes, 0 No) 
Conditional Use Request:  Owner and Petitioner:  God Green Acres,
Ltd., Gordon Giese
Chairman Binder read the conditional use request of God Green Acres,
Ltd.  The points listed in Section 4.3 of the Town of Theresa Zoning
Ordinance were discussed.
1.  A safe driveway is questionable on that hill
2.  Water pollution including sedimentation could be an issue due to
the stream
3.  There are existing drainage features and vegetation cover
4.  No floodplain at the location
5.  Erosion could be an issue – would have to check with the DNR
6.  Location is near roads
7.  Not applicable
8.  Compatible with use on adjacent land
9.  Septic system would have to be approved be the county
10.  Structure is not consistent with agricultural use.
The four points in Section 4.11 were then discussed.
1.  The proposed residential use will not adversely affect
agricultural operations
2.  The site is not suited for agricultural use due to the steep
incline and shape of the parcel
3.  The site proposed is questionable as to driveway safety and
proximity to stream
4.  The proposed residential use would be in conformance with the
Comprehensive Plan 
Vote:  The Board voted to grant the Conditional Use Permit with the
condition that all state, county, and local rules and regulations are
met.  (7 Yes, 0 No)
A motion was made by Rick Steger to adjourn the meeting.  Motion was
seconded by Loren Christian.  Motion carried (7 ayes).  Meeting was
duly adjourned at 9:25 p.m.
