Theresa Town Board   _       Regular Meeting  __       May 7, 2007

The regular meeting of the Theresa Town Board was held on May 7, 2007
in the Theresa Town Hall.  The agenda for this meeting was posted at
the Town Hall Board, TSB Bank, and the Theresa Post Office.   

The meeting was called to order by Chairman Paul Christian at 7:30
p.m.  The Pledge of Allegiance was recited.  A motion was made by
Supervisor Frank Kuczkowski and seconded by Supervisor Brian Caspary
to approve the agenda.  Motion carried. (3 ayes)  The minutes of the
April 2, 2007 meeting were read by the clerk.  A motion was made by
Supervisor Caspary and seconded by Supervisor Kuczkowski to approve
the minutes.  Motion carried (3 ayes). 

FINANCIAL
The financial report was given by Treasurer Diane Koch.  A motion was
made by Supervisor Kuczkowski and seconded by Supervisor Caspary to
approve the financial report as given.  Motion carried.  (3 ayes)  
Budget status report was reviewed.  Supervisor Kuczkowski motioned to
approve payment of the bills.  Motion was seconded by Supervisor
Caspary.  Motion carried.  (3 ayes)

PUBLIC FORUM
Dick Fink spoke about zoning issues including the need for a zoning
administrator, errors and omissions, the Board of Appeals, and a
subdivision ordinance.  It was suggested that Patrick Madden be asked
to be zoning administrator.  Don Radeck questioned if work needed to
be done on Zion Church Rd. and suggested that Michels Materials’ road
bond be increased.  Scott Bernhard had a question as to how committee
appointments are made.  Chairman Christian stated that he makes the
appointments.  Bernhard suggested that the Town Board should work
together on making the appointments.  

CORRESPONDENCE
-Letter from the Theresa Lions Club regarding purchase of the copy
machine.  They will pay half the purchase price, but they will not pay
for the service agreement.
-Guardian Pipeline Environmental Impact Statement has been received.
-Letter from Chuck Rhein concerning Guardian Pipeline was read.
-Guardian Pipeline sent notice of public comment meetings which will
be held in the area.
-Dodge County Board of Supervisors approved a new ordinance dealing
with highway access/driveways. 

UNFINISHED BUSINESS
-Animal Nutrition property – Chairman Christian spoke with Dodge
County Treasurer Patti Hilker.  She said the County will not do
anything with the property.  The Town would have to pay the back taxes
and pass a resolution stating that the Town is going to take it over. 
Orv Burtard said that there is gas contamination and there is a fund
available to help pay for the clean-up work.  He also said that the
roofs were leaking and there was two feet of water in the basement. 
He would make an “as is” offer, above the cost of the back taxes, to
purchase the building to use for storage.  It was suggested that the
Board ask the assessor to lower the assessment on the property and
talk to the Town’s attorney about purchasing and reselling the
property.

NEW BUSINESS
-Veolia Services:  Their representative asked if they could give the
Board a proposal on garbage pick-up as our contract with Waste
Management is up this fall.  The Board agreed to accept a proposal
before the June meeting.
-Fire Commission Report:  The Fire Department is negotiating with the
Ambulance Service about paying rent to the Fire Department.  The Fire
Department is working on some upgrades at the firehouse.
-Fleischer Re-zoning:  Dennis and Lisa Fleischer requested to re-zone
approximately twenty acres from A-1 Agriculture to A-2 Agriculture in
order to separate their house from the larger 



parcel of land.  The Planning and Zoning Commission approved the
re-zoning and also a conditional use permit to create three parcels
from the re-zoning:  a twenty-acre parcel including the house, a
45-acre parcel which will remain in A-1, and a remnant twenty-acre
parcel which would have be re-zoned from A-1 to A-2.  A motion was
made by Supervisor Caspary and seconded by Supervisor Kuczkowski to
approve the re-zoning.  Motion carried (3 ayes).
-County Zoning:  Chairman Christian stated that an advisory vote was
taken at the annual meeting and the vote was 27-26 in favor of keeping
local town zoning.  Chairman Christian said he would like to stay with
our Town zoning.  Supervisor Caspary said he wanted to stay with Town
zoning, but we need to get a zoning administrator.  A motion was made
by Chairman Christian to stay with Town zoning.  Motion was seconded
by Supervisor Caspary.  Motion carried (2 yes).  Supervisor Kuzckowski
abstained from voting.  
-Comprehensive Plan:  Chairman Christian read a letter written by
Diane Koch explaining how the Town could do its own Comprehensive Plan
and what the estimated costs would be.  A motion was made by Chairman
Christian to have the Town go ahead with working on the Comprehensive
Plan and appointing Diane Koch as chairperson of the committee. 
Motion was seconded by Supervisor Caspary.  Motion carried (3 ayes). 
Supervisor Caspary motioned that the Comprehensive Plan committee
members would each be paid $20 per meeting.  Motion was seconded by
Chairman Christian.  Motion carried (3 ayes).  Comprehensive planning
will be put on the agenda every month until complete.

Motion was made by Supervisor Caspary and seconded by Supervisor
Kuczkowski to adjourn the meeting.  Motion carried (3 ayes).  The
meeting was duly adjourned at 9:15 p.m.
