 Theresa Town Board   _       Regular Meeting  __       November 2,
2009

The regular meeting of the Theresa Town Board was held on November 2,
2009 in the Theresa Town Hall.  The agenda for this meeting was posted
at the Town Hall Board, TSB Bank, and the Theresa Post Office.   

The meeting was called to order by Chairman Paul Christian at 7:30
p.m.  The Pledge of Allegiance was recited.  A motion was made by
Supervisor Brian Caspary to approve the agenda.  Supervisor Frank
Kuczkowski seconded.  Motion carried. (3 ayes)   The minutes of the
October 6 meeting were read by the clerk.  A motion was made by
Supervisor Kuczkowski and seconded by Supervisor Caspary to approve
the minutes.  Motion carried (3 ayes).   The minutes from the October
21 Special Meeting were read by the clerk.  Supervisor Caspary
motioned to approve the minutes.  Supervisor Kuczkowski seconded. 
Motion carried (3 ayes).  The clerk read the minutes from the October
27 Special Meeting.  A motion was made by Supervisor Caspary and
seconded by Supervisor Kuczkowski to approve the minutes.  Motion
carried (3 ayes).

FINANCIAL
The financial report was given by Clerk Diane Steger due to Treasurer
Diane Koch’s absence.  A motion was made by Supervisor Kuczkowski and
seconded by Supervisor Caspary to approve the financial report as
given.  Motion carried.  (3 ayes)   Budget status report was reviewed.
 Supervisor Caspary motioned to approve payment of the bills. 
Supervisor Kuczkowski seconded.  Motion carried (3 ayes).  

PUBLIC FORUM
-Gerald Adelmeyer, Town Humane Officer, reported that he spoke with
the dog owners about the complaint.  
-Mike Jackson of the Theresa Fire Department told the Board that the
valves on the tanker truck need adjusting and there is an exhaust
leak.  Mitch Verhunce would do the repairs for $292.50.  The Board
told him to go ahead with the repairs.
-Scott Bernhard reported that the Fire Commission approved a $500 flat
charge for non-residents for Fire Department response to car
accidents, car fires, and/or extractions.  The money is to be put into
a fire equipment fund.  The Town will need to adopt a resolution
approving the charge.
 
CORRESPONDENCE
-Batzler Trucking sent a letter with prices for sand.
-Supervisor Caspary received a couple of phone calls about trees down
in the roadway after a recent windstorm.

UNFINISHED BUSINESS
- Comprehensive Planning Committee:  A meeting was held on Oct. 22. 
The Committee started looking at the future land use maps and
designating areas for development, conservation, etc.  The next
meeting will be on Dec. 2. 
-Mark Piwoni Property:   Piwoni and his attorney were present.  Piwoni
stated that the deadline of Sept. 21 was to have the shed down and the
shed was down shortly after.  He said the fines are inappropriate as
he was in compliance.  He also said that people are still dumping
stuff.  Chairman Christian will talk with Attorney Patrick Madden to
see if they can set up a meeting with the Board, building inspector,
and Piwoni to determine what still needs to be cleaned up.
-Conditional Use Permit Renewal fee increase:  If was discussed as to
whether or not the Land Use Administrator could grant renewals if
there are no changes.  Chairman Christian will ask Attorney Madden.
-Guardian Pipeline Assessment:  The pipeline will be assessed as
Personal Property in 2010.
-Speed limit near Veterinary Clinic:  Still waiting to hear back from
the contractor.

NEW BUSINESS
-Wireless internet:  Theresa Lions were interested in having wireless
internet at the Town hall, but have not gotten back with prices.
-Discuss Adelmeyer Quarry:  Gerald Adelmeyer asked the Board if he
could continue operations at his pit as there is a reclamation plan on
file at the county.  The Planning and Zoning Board had laid over a
decision on his renewal because they weren’t sure if there was a plan.
 Chairman Christian motioned that the Adelmeyer Quarry can remain open
and operating.  The motion was seconded by Supervisor Caspary.  Motion
carried (3 ayes).  The renewal will be reviewed at the next Planning
and Zoning Board meeting.
-Budget Resolution 11-2-09:  A resolution to amend the 2009 budget
increasing revenues by $33,048 due to FEMA aid and LRIP funds received
and increase highway expenditures (Road Paving) by that amount.  Also,
transferring $2000 from Gas and Diesel and $2000 from Other Material
Purchases to Equipment Repair; and $600 from Equipment Insurance to
Road Paving.  A motion was made by Supervisor Caspary and seconded by
Supervisor Kuczkowski to adopt the resolution.  Motion carried (3
ayes).
-Gordon Giese Re-Zoning:  Supervisor Kuczkowski motioned to approve
re-zoning approximately two acres of A-1 Agricultural land to A-2
General Agricultural land.  The land is located in tax key
042-1217-3211-000.  Supervisor Caspary seconded the motion.  Motion
carried (3 ayes).
-LRIP Program:  The Town will probably not participate in the program
this year due to budget constraints.
-Budget:  Budget hearing will be on November 16 at 7:30 p.m.

A motion was made by Supervisor Kuczkowski and seconded by Supervisor
Caspary to adjourn the meeting.  Motion carried (3 ayes).  The meeting
was duly adjourned at 8:55 p.m.
