Town of Theresa Appeals Board Meeting

Date:  November 30, 2005
Owner and Petitioner:  Audrey Peardon
					
Request:  A Conditional Use Permit to allow the building of two homes.

Board Members Present:  William Budahn, Robin Lindert, Ken Schoebel,
Perry Billings (alternate), Stan Unertl (alternate).  Gene Grulke and
Dale Christian absent.
Acting Chairman William Budahn called the meeting to order at 8:00
p.m.  The above request was discussed. Arnie Mueller, on Audrey
Peardon’s behalf, explained the request and answered questions. 
The Board of Appeals reviewed the checklist for Appeals, Variance, and
Exceptions.  The board answered the questions as follows:
1.Would proposed use be hazardous, harmful, noxious, offensive or a
nuisance to the neighborhood?   		  NO             
2.Would the proposed us with respect to location, construction,
maintenance, or operation adversely effect adjacent properties and the
public?                                                               
                                                                      
                  	  NO 	          
3.Would the establishment, maintenance or operation of the request be
unreasonably detrimental to or endanger the public health, safety,
morals, comfort, or general welfare?                                  
                 	  NO             
4.Would granting the request injure the use and enjoyment of other
property in the immediate vicinity of the purposes already permitted
or substantially diminish and impair property values within the
neighborhood?                                                         
 						          	  	  NO            
5.Would the establishment of the variance impede the normal and
orderly development and improvement of surrounding property for uses
permitted in the district?                                           
	  	   NO            
6.Will the utilities, access roads, drainage and/or other necessary
facilities be inadequate?                     	  	   NO            
7.Would ingresses and egress cause traffic congestion in the public
streets?                                            	  	   NO         
  
8.Would the request in any other respect, conflict with any other
applicable regulations of the district in which it is
located?										            	  	   NO
9.Has the applicant shown/proved that a hardship exists for the
applicant to literally comply with the code?											           	  	
  NOT APPLICABLE         
10.Would granting the variance violate the spirit of the zoning code,
harm public safety and welfare or otherwise to substantial injustice? 
								          	  	   NO

The Board approved the request to allow the building of two houses as
shown on the sketch map.

The Board then went to the next item on the agenda:

Owners and Petitioners:  Broc and Aubrey Fleischer

Request:  To Re-Zone approximately two acres from A-1 Agricultural to
A-2 Agricultural and allow the building of a home.

Broc Fleischer explained the request and answered questions.  
The Board of Appeals reviewed the checklist for Appeals, Variance, and
Exceptions.  The board answered the questions as follows:

The Board of Appeals approved the request to re-zone approximately two
acres from A-1 Agricultural to A-2 Agricultural and to allow the
building of a home.

A motion to adjourn was made by Ken Schoebel and seconded by Robin
Lindert.  Meeting adjourned at 9:00 p.m.
