October 19, 2011 Zoning & Planning Commission Minutes

TOWN OF THERESA ZONING AND PLANNING COMMISSION
October 19, 2011

The October 19, 2011 meeting of the Zoning and Planning Commission was
called to order by Chairman Harlan Binder at 8:05 p.m.   Other board
members present were Todd Bodden, Jim Krieger, Rick Steger, Brian
Priestaf, Jeff Justman, and Dan Schmidt.  The minutes from the
September 14, 2011 Zoning and Planning Commission meeting were read by
the clerk.  Rick Steger motioned to approve the minutes and Todd
Bodden seconded.  Motion carried (7 ayes). 

Owner and Petitioner:  Aaron & Kari Karnitz

Chairman Binder read the Conditional Use Permit Renewal application of
Aaron and Kari Karnitz.  Aaron said there would be no changes from the
original Conditional Use Permit.  He hopes to start building in 2013.
Vote:  7 Yes, 0 No
The Conditional Use Permit to build a home was renewed for Aaron &
Kari Karnitz.
 
Owner and Petitioner:  William Steinbach

Chairman Binder read the Re-Zoning and Conditional Use applications of
William Steinbach. William explained that he would like to sell the
buildings and keep the rest of the land in Ag-1.  The parcel with the
buildings on it would be approximately 2.9 acres.  The Conditional Use
application is to create the new parcels from the re-zoning.  The
points in 4.3 and 10.6 of the Town of Theresa Zoning Ordinance were
reviewed.  
Re-Zoning Vote:  7 Yes, 0 No
Conditional Use Permit Vote:  7 Yes, 0 No
The Re-zoning and Conditional Use permit were granted to William
Steinbach.

Owner:  Milton Retzlaff
Petitioner:  Sal Okon

Chairman Binder read the Conditional Use application of Milton
Retzlaff/Sal Okon.  Sal proposed to divide the Retzlaff property into
smaller parcels.  All land would remain zoned Ag-1.  Road frontage was
a concern as 200’ of road frontage is required for a lot according to
the Zoning Ordinance.  One of the lots proposed did not have enough
road frontage.  Rick Steger made a motion to accept the lots as drawn
out on the map, except the Lot 3 on the south parcel.  That parcel
would be changed to have 200’ road frontage and 67’ setback .  Dan
Schmidt seconded the motion.  Lot 3 would be subject to approval of a
legal driveway from the county and the state.  Motion carried (7 yes,
0 no).  The points in 4.3 of the Town of Theresa Zoning Ordinance were
reviewed.  
Vote:  7 Yes, 0 No
The Conditional Use permit of Sal Okon/Milton Retzlaff was granted.

A motion was made by Todd Bodden to adjourn.  Motion was seconded by
Jim Krieger.  The 
meeting was duly adjourned at 9:45 p.m.
